年と 2017 年のケニアでの総選挙は比較的平和裏に実施され、暴力的な争いは限定的であった。他方で、ケニアでは選挙をめぐる裁判が増加し、権力に対する司法という公式なルールが果たす役割が高まる司法化の進捗がみられた。近年、アフリカではケニアのほかにも、マラウイ、ザンビア、ナイジェリアなどで、大統領選挙に関連した裁判が提起され、権力に対する公式なルールが果たす役割は高まっている。上記のいずれの国でも大規模な暴力には至っておらず、アフリカ域内の選挙をめぐる司法化は、平和な選挙の実施における重要な要素かもしれない。そこで本稿は、ケニアの選挙をめぐる司法化が、次回 2022 年に予定されている大統領選挙にどのような影響を与えているのか、裁判所での議論を手がかりに考察した。そして、ケニアでは制度改革を契機とした司法化が進捗する一方で、法に基づく公式な制度が、法に基づかない非公式な制度に補完されている現況を本稿での考察によって明らかにした。このため、必ずしも裁判にて紛争そのものが解決されるとは言い切れず、政治エリートの個人的な取引が引き金となって、2022
