年代に会社のための土地収用が深刻な社会問題を引き起こし，1894 年制定の土地収用法が2013 年制定の法に代置された。ただし，新法もまた多くの規定を旧法から引き継いでいる。そこで，本稿はインドにおける土地収用制度の導入過程を検討し，その起源が東インド会社統治時代の19 世紀前半にあり，直接統治が始まった19 世紀半ば頃までにはその骨格が形成されていたことを示す。また，そのおもな特徴として，第一に，現地社会の土地に関する複雑な権利関係を認める一方で，土地に関するイギリス側の主権が曖昧であるという法的な枠組みが出発点となっており，それゆえ，対象となる土地に関する既存の権利関係をいわば清算して政庁側が当該土地に関する瑕疵なき権利を入手する仕組みが必要となったと考えられることを論じる。第二に，私企業による鉄道建設を含むとされた公共目的のための条項と，それとは別と位置づけられた会社のための土地収用の条項が，それぞれ1850 年代，60
